Terms of service

Pancakes is operated by Event Atlas LLC, a Delaware limited liability company ("Pancakes", "we", "us"). These terms apply when you create an account, build or publish a site, buy a plan or setup service, or otherwise use the Pancakes website builder, dashboard, and hosting (the "Service").

By creating an account or using the Service, you agree to these terms and to our privacy policy. If you use Pancakes for a business, you confirm that you can accept these terms for it, and "you" means that business.

You must be at least 18 years old and give us accurate information. Keep your password private. You are responsible for what happens in your workspace, including the actions of team members you invite. Tell us promptly at [email protected] if you think someone has accessed your account without permission.

Paid plans are billed in advance, monthly or annually, through our payment processor, Stripe. Plans renew automatically at the end of each billing period until you cancel. Prices are shown on the pricing page and do not include taxes, which we add where required.

You can change or cancel your plan from Billing in your dashboard. A cancellation takes effect at the end of the period you have paid for, and your site stays published until then. Except where the law requires otherwise, we do not refund partial billing periods.

Setup services, such as assisted setup, are one-time charges for work our team performs. If we have not started the work, you may cancel for a full refund by writing to us.

We may change plan prices or features. We will tell you at least 30 days before a price increase affects your next renewal, and you can cancel before it takes effect.

You own the words, photos, logos, and other material you add to Pancakes ("your content"). You give us a limited license to host, copy, process, display, and publish your content only as needed to run the Service for you, including resizing images, generating previews, and making backups.

You are responsible for your content and your sites: that you have the rights to use it, that it is accurate, and that it follows the law, including rules on advertising, pricing, and privacy. When your site collects information from visitors, such as form submissions or newsletter signups, you decide what to collect and how to use it, and you are responsible for telling visitors how you handle it. We process that information on your behalf.

Themes, templates, sample content, and the Pancakes software remain ours. You may use them on your Pancakes sites while your account is active.

You agree not to use Pancakes to:

• break the law or infringe anyone's rights;
• publish content that is fraudulent, deceptive, hateful, harassing, sexually exploitative, or that promotes violence;
• collect passwords, payment details, or sensitive personal data through site forms without a lawful reason and clear notice;
• send spam or distribute malware;
• interfere with the Service, probe or bypass its security, or use it in a way that places an unreasonable load on it; or
• resell the Service without our written agreement.

Custom code you add to a site runs on your visitors' browsers. You are responsible for it and for any third-party services it loads.

Some features use AI to draft content, suggest calendar changes, or propose edits. AI output can be incomplete or wrong. Review it before you publish or schedule it; you are responsible for what goes live on your site. AI at Pancakes explains what these features see and which providers we use.

The site calendar can remind you about dates and make changes you approve at a time you choose, then undo them. Reminders and suggestions are a convenience, not a guarantee. We work to apply scheduled changes on time, but they can be delayed or held, for example when the page changed after you approved the edit. Check anything time-sensitive, such as holiday hours or prices, on your live site.

Assisted setup, edit requests included with a plan, and custom projects are performed by the Pancakes team. We describe the scope when you buy them, such as the number of revision rounds or monthly requests. Unused requests do not carry over. Custom projects may have their own written agreement, which controls if it conflicts with these terms.

If you connect your own domain, you remain its registrant and are responsible for keeping it registered and its DNS pointed at Pancakes. Integrations you choose to connect, such as Google Business Profile, Calendly, Mailchimp, Klaviyo, Stripe, or Zapier, are governed by those providers' own terms. We are not responsible for services we do not operate.

We may suspend or close an account that breaks these terms, puts other customers or the Service at risk, or has an unpaid balance. Where we reasonably can, we will tell you first and give you a chance to fix the problem.

You can delete your workspace at any time. When a workspace is deleted, its sites go offline and we delete its content as described in our privacy policy. Download anything you want to keep, such as leads or newsletter signups, before you delete it.

We work hard to keep Pancakes available, secure, and correct, but the Service is provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, and we do not promise the Service will be uninterrupted or error-free.

To the extent the law allows, neither you nor we will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. These limits do not apply to your payment obligations or to either party's liability that cannot be limited by law.

You will defend and indemnify Event Atlas LLC against third-party claims arising from your content, your sites, the information your sites collect, or your breach of these terms.

We may update these terms. If a change materially affects your rights, we will tell you by email or in the dashboard at least 30 days before it takes effect. Continuing to use Pancakes after that date means you accept the updated terms.

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute will be heard in the state or federal courts located in Delaware, and both parties consent to their jurisdiction.
